1. Acceptance

These Terms of Service ("Terms") govern your use of the River AI TCG mobile app and website (the "Service"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use the Service.

River AI TCG helps Pokémon TCG collectors look up card prices, scan cards with their camera, track collections, and chat with an AI assistant ("River") about the market. Features include:

3. Eligibility

You must be at least 13 years old to use River AI TCG (16 in the EU and UK). If you are under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian. By using the Service you represent that you meet these requirements.

4. Accounts

You sign in with Apple or Google through our authentication provider. You are responsible for keeping that account secure, for all activity under your River AI TCG account, and for not sharing your account or impersonating others. One account per person. We may suspend or close accounts that violate these Terms.

Some features ("River AI TCG Pro") require a paid subscription, sold through the Apple App Store or Google Play and managed through our subscription-management provider.

6. AI features and accuracy

The "River" chat assistant uses a third-party AI provider together with the data we make available to it. AI outputs are informational and conversational only. They are not financial, investment, legal, tax, or grading advice (see Section 7). AI outputs may be incorrect, incomplete, or outdated, and should not be relied on for buy/sell decisions, valuations for insurance or taxes, or any other consequential transaction. You are solely responsible for any decision you make based on AI output.

River AI TCG is a research and information tool for collectors. Everything the Service provides — including live and historical prices, recent sales, price-history charts, and the outputs of our market-analysis features (such as momentum, volatility, grade-spread, and liquidity "signals," trend percentages, and any "conviction"-rated or similar ratings generated by the River assistant) — is provided for general informational and educational purposes only.

None of it is financial, investment, brokerage, trading, tax, accounting, appraisal, or grading advice, and none of it is a recommendation, solicitation, or offer to buy, sell, or hold any card, sealed product, or other collectible. River is not a financial adviser, broker, dealer, or appraiser, and using the Service does not create any advisory or fiduciary relationship.

Trading cards and sealed products are collectibles whose prices can be volatile, illiquid, and influenced by factors no model can fully see. Market-analysis outputs are automated estimates derived from third-party data that may be delayed, incomplete, or inaccurate. Past performance and historical trends do not predict future prices, and any rating, score, or "conviction" level reflects an automated heuristic, not a guarantee of any outcome.

You are solely responsible for your own buying, selling, grading, insurance, and tax decisions. Always do your own research, and consider consulting a qualified professional, before acting on anything you see in the Service. To the maximum extent permitted by law, we are not liable for any loss arising from your reliance on prices, data, or market analysis provided through the Service.

8. Pricing and market data

Card prices, sold-listing data, and the inputs to our market-analysis features come from a third-party market-data provider that aggregates market prices and recorded sold listings from major marketplaces (including TCGplayer prices and eBay sold listings) across English and Japanese cards. This data is provided "as is" and may be delayed, missing, or incorrect. Prices, sale counts, condition labels, and grades reflect what those sources report. We do not guarantee the accuracy, completeness, or timeliness of any data shown in the Service.

"User content" includes your collections, prices paid, condition selections, and the messages you send to River. You retain ownership of your content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, and process your content only as needed to operate the Service — for example, sending it to our AI provider to generate a response. You are responsible for your content; don't upload anything that infringes someone else's rights or violates the law.

11. Pokémon TCG intellectual property

River AI TCG is not affiliated with, endorsed by, sponsored by, or in any way connected to The Pokémon Company International, Inc., Nintendo, Game Freak, Creatures Inc., or any of their subsidiaries.

"Pokémon," "Pokémon Trading Card Game," all card names, set names, character names, artwork, and related logos are trademarks or copyrights of their respective owners. We display card names, set codes, numbers, and images solely to help you identify cards in your collection — a use we believe is consistent with nominative fair-use principles. If you are a rights-holder and have a concern about specific content shown in the Service, contact us at [email protected] and we'll review it promptly.

12. Third-party services

The Service depends on third-party providers, including the Apple App Store and Google Play, our authentication provider, our subscription-management provider, our AI provider, our market-data provider, and our database and app build-and-delivery infrastructure. Your use of those services is subject to their own terms. We are not responsible for the actions, errors, downtime, or content of third-party providers.

13. Termination

You can stop using the Service at any time and request account deletion by emailing [email protected]. We may suspend or terminate your account if you violate these Terms, abuse the Service, or for any reason with reasonable notice. Upon termination, your active Pro subscription will continue until the end of its current billing cycle, but no refund is owed for the unused portion.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR BE ERROR-FREE.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RIVER AI AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (a) THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (b) USD $100.

16. Indemnification

You agree to indemnify and hold River AI TCG harmless from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Service, your violation of these Terms, or your infringement of any third-party rights.

17. Governing law and dispute resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Before filing any legal action, please contact us at [email protected] so we can try to resolve the issue informally. If we can't, exclusive jurisdiction lies with the state and federal courts located in Delaware. Where permitted by law, you and River AI TCG waive any right to bring claims as a class member or class representative.

18. Changes to these Terms

We may update these Terms. Material changes will be posted in-app and on this page with a new "Last updated" date. If you keep using the Service after the change, you accept the updated Terms.
