Terms of Service

1. Acceptance

These Terms of Service ("Terms") govern your use of the River AI TCG mobile app and website (the "Service"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use the Service.

2. The Service

River AI TCG helps Pokémon TCG collectors identify cards, look up prices, track what they own and what they're selling, and chat with an AI assistant ("River") about the market. Features include:

• Search and browse across cards, sets, and sealed products (English and Japanese)
• Live pricing and recent sold-listing data from major marketplaces
• Price-history charts and recent comparable sales
• On-device card scanning with the camera — one card at a time, or a full binder page
• Collections, with the exact variant, condition, or grade of each copy and an optional price paid
• Favorites and watchlists
• A selling inventory ("Vending") for tracking asking prices and completed sales
• Portfolio value tracking, with a daily history and cost-basis comparison
• AI-driven market analysis — momentum, volatility, grade-spread, and liquidity "signals"
• A conversational AI assistant ("River") that can answer questions about your own collection and prepare actions for you to confirm
• Premium features under the "River AI TCG Pro" subscription

The Service is currently offered on iOS. It requires an active internet connection — your collection is stored on our servers, and the app is not designed to work offline.

3. Eligibility

You must be at least 13 years old to use River AI TCG (16 in the EU and UK). If you are under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian. By using the Service you represent that you meet these requirements.

4. Accounts

You sign in with Apple or Google through our authentication provider. You are responsible for keeping that account secure, for all activity under your River AI TCG account, and for not sharing your account or impersonating others. One account per person. We may suspend or close accounts that violate these Terms.

5. Subscriptions and billing

River AI TCG has a free tier and a paid tier.

Free. With an account and no subscription, you can search and browse the card catalog — cards, sets, and sealed products. Market prices are not included.

River AI TCG Pro. A subscription unlocks the rest of the Service, including:

• All pricing data — market prices, price history, and sold listings
• The River AI assistant
• Collections, favorites, selling inventory, and portfolio tracking, including storing and synchronizing them to your account

Because your collection is stored on our servers as part of the Pro feature set, building a collection requires an active subscription.

Subscriptions are sold through the Apple App Store and managed through our subscription-management provider.

• Subscriptions auto-renew until you cancel
• Prices are shown in your local currency at checkout
• Cancel anytime through your Apple ID subscription settings
• Refunds are handled by Apple per their policies; we generally don't issue refunds directly
• We may change pricing; you'll be notified before any change takes effect on your subscription
• We verify your subscription status with our subscription-management provider rather than relying on the app. If that provider is temporarily unreachable, a previously verified subscription keeps working during a short grace period

If your subscription lapses, Pro features stop working, but we do not delete anything. Your collections, favorites, selling inventory, and portfolio history are retained, and resubscribing restores access to them as you left them. Deleting your account is the only action that erases them — see Section 15.

6. AI features and accuracy

The "River" chat assistant is powered by the Google Gemini API, a third-party AI service operated by Google, together with the data we make available to it, including your own collection data when your question calls for it. AI outputs are informational and conversational only. They are not financial, investment, legal, tax, or grading advice (see Section 7). AI outputs may be incorrect, incomplete, or outdated, and should not be relied on for buy/sell decisions, valuations for insurance or taxes, or any other consequential transaction. You are solely responsible for any decision you make based on AI output.

Assistant-proposed actions. River can prepare a proposal to change your data — adding a card to a collection or watchlist, adding an item to your selling inventory, setting an asking price, or marking an item sold. These proposals never execute on their own; nothing changes until you confirm it in the app. A proposal may misidentify a card, variant, condition, or grade. Review every proposal before confirming it — once you confirm, you are responsible for the resulting entry, including any effect it has on your portfolio figures.

7. No financial or investment advice

River AI TCG is a research and information tool for collectors. Everything the Service provides — including live and historical prices, recent sales, price-history charts, your portfolio's total value and value history, cost-basis and gain/loss figures, grading-upside scenarios, asking-price-versus-market comparisons, and the outputs of our market-analysis features (such as momentum, volatility, grade-spread, and liquidity "signals," trend percentages, and any "conviction"-rated or similar ratings generated by the River assistant) — is provided for general informational and educational purposes only.

None of it is financial, investment, brokerage, trading, tax, accounting, appraisal, or grading advice, and none of it is a recommendation, solicitation, or offer to buy, sell, or hold any card, sealed product, or other collectible. River is not a financial adviser, broker, dealer, or appraiser, and using the Service does not create any advisory or fiduciary relationship.

Portfolio values are estimates, not appraisals. The value we show for your collection is calculated by matching each copy you recorded against third-party market data for that exact configuration. It depends on you having entered your cards, variants, conditions, and grades correctly; it excludes fees, shipping, and taxes; it omits any item we have no price for; and it can move for reasons that have nothing to do with your collection, such as a data provider correcting or delaying a price. Do not use these figures for insurance, tax, estate, lending, or accounting purposes. Get a qualified independent appraisal instead.

Grading scenarios are arithmetic, not predictions. Where the Service compares a raw card's value against graded market values, it is showing what the numbers would look like at a given grade using an estimated grading cost. It is not a prediction of the grade your card would receive, and it excludes shipping, insurance, selling fees, and turnaround time.

Trading cards and sealed products are collectibles whose prices can be volatile, illiquid, and influenced by factors no model can fully see. Market-analysis outputs are automated estimates derived from third-party data that may be delayed, incomplete, or inaccurate. Past performance and historical trends do not predict future prices, and any rating, score, or "conviction" level reflects an automated heuristic, not a guarantee of any outcome.

You are solely responsible for your own buying, selling, grading, insurance, and tax decisions. Always do your own research, and consider consulting a qualified professional, before acting on anything you see in the Service. To the maximum extent permitted by law, we are not liable for any loss arising from your reliance on prices, data, portfolio figures, or market analysis provided through the Service.

8. Your collection and selling inventory

Collections, favorites, selling inventory, and portfolio history are stored on our servers and synchronized to your devices. The copy on your device is a cache; our servers hold the authoritative version.

• Accuracy is yours. We record what you enter. If a variant, condition, grade, price paid, or sale price is wrong, everything derived from it — portfolio value, cost basis, gain/loss — will be wrong too.
• We are not a marketplace. The Vending feature is a private record-keeping tool. We do not list your items for sale, host transactions, take payment, facilitate shipping, or act as a party to, agent for, or escrow in any sale you make. Sales you record happen entirely outside the Service.
• We provide no tax or accounting reporting. Sale records, revenue totals, and cost-basis figures are for your own reference. They are not tax documents and are not prepared to any accounting standard. Your tax obligations are yours to determine, with a qualified professional.
• Value figures depend on third-party data. Prices are refreshed periodically in the background rather than continuously, and may be stale, missing, or incorrect. Where we have no price for a configuration you own, it is left out of your total rather than counted as zero.
• Back up what matters to you. We take reasonable care, but we do not guarantee against data loss, and we are not liable for lost, corrupted, or unavailable collection data. Keep your own records of anything you can't afford to lose.

9. Pricing and market data

Card prices, sold-listing data, and the inputs to our market-analysis features come from a third-party market-data provider that aggregates market prices and recorded sold listings from major marketplaces (including TCGplayer prices and eBay sold listings) across English and Japanese cards. This data is provided "as is" and may be delayed, missing, or incorrect. Prices, sale counts, condition labels, and grades reflect what those sources report. We cache and periodically refresh this data rather than fetching it live on every view, so what you see may be up to a day old or older. We do not guarantee the accuracy, completeness, or timeliness of any data shown in the Service.

10. Card scanning

Card recognition runs on your device using a model bundled with the app. Camera images are not uploaded to us or to any third party. Recognition is probabilistic and will sometimes be wrong, especially for foils, reprints, near-identical alternate arts, and cards from sets released after your installed version of the app. Always confirm the match before adding a card — you are responsible for what ends up in your collection. Card scanning is available on iOS.

11. Acceptable use

You agree not to:

• Reverse engineer, decompile, or attempt to derive source code, models, or model weights from the app
• Extract, copy, or redistribute our card catalog, pricing data, or the bundled recognition model
• Scrape, crawl, or systematically access our APIs outside the app
• Bypass rate limits, usage limits, paywalls, entitlement checks, or authentication
• Use the Service for any illegal purpose, harassment, or to infringe others' rights
• Submit malicious content, exploit vulnerabilities, or attempt to disrupt the Service
• Create multiple accounts to abuse free quotas or evade bans
• Misrepresent your identity or attempt to impersonate others

The Service applies rate limits and a daily AI usage allowance to keep costs and capacity sustainable. We may adjust these limits.

12. Your content

"User content" includes your collections, prices paid, condition and grade selections, favorites, selling inventory and sales records, and the messages you send to River. You retain ownership of your content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, and process your content only as needed to operate the Service — for example, storing your collection so it survives a lost device, calculating your portfolio value, or sending relevant details to Google, our AI provider, to answer a question you asked — which the app asks your permission for before it happens, and which you can withdraw in Settings → Privacy. We do not use your content to train AI models. You are responsible for your content; don't upload anything that infringes someone else's rights or violates the law.

13. Pokémon TCG intellectual property

River AI TCG is not affiliated with, endorsed by, sponsored by, or in any way connected to The Pokémon Company International, Inc., Nintendo, Game Freak, Creatures Inc., or any of their subsidiaries.

"Pokémon," "Pokémon Trading Card Game," all card names, set names, character names, artwork, and related logos are trademarks or copyrights of their respective owners. We display card names, set codes, numbers, and images solely to help you identify cards in your collection — a use we believe is consistent with nominative fair-use principles. If you are a rights-holder and have a concern about specific content shown in the Service, contact us at [email protected] and we'll review it promptly.

14. Third-party services

The Service depends on third-party providers, including the Apple App Store, our authentication provider, our subscription-management provider, Google (Gemini API) as our AI provider, our market-data provider, our cloud hosting and database infrastructure, an edge-network provider for shared card links, and our app build-and-delivery infrastructure. Your use of those services is subject to their own terms. We are not responsible for the actions, errors, downtime, or content of third-party providers.

15. Termination

You can stop using the Service at any time. You can delete your account yourself from Settings → Delete Account in the app. Deletion is immediate and permanent: it erases your profile, collections, favorites, selling inventory and sales history, portfolio history, and synchronization state, and it cannot be undone. Deleting your account does not cancel your subscription — cancel that separately through your Apple ID subscription settings, or billing will continue.

We may suspend or terminate your account if you violate these Terms, abuse the Service, or for any reason with reasonable notice. Upon termination, your active Pro subscription will continue until the end of its current billing cycle, but no refund is owed for the unused portion.

16. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE ERROR-FREE, IDENTIFY CARDS CORRECTLY, VALUE YOUR COLLECTION ACCURATELY, OR PRESERVE YOUR DATA WITHOUT LOSS.

17. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RIVER AI AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR COLLECTION VALUE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (a) THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (b) USD $100.

18. Indemnification

You agree to indemnify and hold River AI TCG harmless from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Service, your violation of these Terms, your sales or other transactions with third parties, or your infringement of any third-party rights.

19. Governing law and dispute resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Before filing any legal action, please contact us at [email protected] so we can try to resolve the issue informally. If we can't, exclusive jurisdiction lies with the state and federal courts located in Delaware. Where permitted by law, you and River AI TCG waive any right to bring claims as a class member or class representative.

20. Changes to these Terms

We may update these Terms. Material changes will be posted in-app and on this page with a new "Last updated" date. If you keep using the Service after the change, you accept the updated Terms.
